This policy describes what personal data Mindflx (the “Controller”) collects through its website, the purposes for which it processes it, who it shares it with, and how you can exercise your rights. It applies to the Mindflx website and its interactive AI agent demos.
1. Data we collect
Data you give us directly: when you write to us on WhatsApp or when, during a demo, you choose to share your name, your preferred contact channel (WhatsApp, SMS, email or phone call), your number or email, and information about your business or need.
WhatsApp conversations: the content of the messages you send us, including voice notes —which are transcribed automatically— and any images or documents you share. The conversation history is kept so we can follow up coherently.
Please note that images you send may contain personal data of third parties (for example, an invoice with your own client's details). Our systems are configured only to recognise what kind of document or process an image shows, not to transcribe such data. We ask you not to share sensitive information that is not necessary.
Voice demo data: when you start a demo call, your microphone audio is transmitted and processed for speech recognition and synthesis, and the conversation is recorded and transcribed. From the transcript we may extract the contact and interest details you voluntarily shared.
Technical data: IP address and basic browser data, used for security, abuse prevention and demo usage limits.
2. Purposes of processing
We use your data to: operate the Site and the demos; respond to your requests and contact you through the channel you chose when you ask us to; follow up commercially on requests for information about our services; improve the quality of the agents and the Site; and prevent abusive use.
WhatsApp conversations are handled by an automated assistant that, based on what you tell us, classifies the interest of your enquiry so our team can follow up appropriately. You can ask to speak with a person at any time, and ask us to stop writing to you: if you do, we will not contact you again.
3. Demos with simulated data
The demos work with fictitious information and do not require you to enter real data. We ask you not to share sensitive or confidential information in them (real financial data, passwords, health information). The only thing we will ask for, and only if you want us to contact you, is your name and a contact detail.
4. Processors and third parties
To operate the Site and WhatsApp support we use providers that process data on our behalf: OpenAI (processing conversations to generate replies, transcribing voice notes and describing images), Google Cloud (storage of leads and conversation history, and spreadsheets for commercial follow-up), ElevenLabs (voice processing: audio transmission, recording, transcription and analysis of demo conversations), Vercel (hosting of the Site and its services) and Meta/WhatsApp (messaging when you write to us through that channel).
These providers may process data on servers located outside your country. In those cases, processing relies on each provider's contractual and security safeguards.
5. Retention
We keep data for as long as necessary for the purposes described: demo recordings and transcripts, for the time required for quality analysis and commercial follow-up; WhatsApp conversation history and the summaries we generate from it, for the duration of the commercial relationship; contact details, for as long as a commercial relationship exists or until you request their deletion.
6. Your rights
In accordance with Colombian Law 1581 of 2012 and other applicable data protection rules, you have the right to know, update and rectify your data, request proof of authorization, be informed about its use, revoke authorization and request deletion of your data, and file complaints with the Superintendence of Industry and Commerce of Colombia.
To exercise these rights, write to us through the WhatsApp channel available on the Site describing your request. We will respond within the legally established timeframes.
7. Security
We apply reasonable technical and organizational measures to protect your data: encryption in transit, access controls and minimization of the data we collect. No system is infallible, but we work to protect your information from unauthorized access.
8. Cookies and local storage
The Site does not use advertising or third-party tracking cookies. We only use technical storage necessary for its operation, such as the cookie that remembers your language preference.
9. Minors
The Site and the demos are intended for adults in business contexts. We do not knowingly collect data from minors.
10. Changes and contact
We may update this policy at any time; the current version will be the one published on this page with its update date. For any questions about this policy or the processing of your data, write to us through the WhatsApp channel available on the Site.
